The lawsuit filed against A.J. Kirkwood & Associates, Inc., alleges that from time to time, employees are unable to take off duty meal and rest breaks and are not fully relieved of duty for their meal periods. Allegedly, the company employees are required to perform work as ordered by A.J. Kirkwood & Associates, Inc., for more than five (5) hours during a shift without receiving an off-duty meal break. California labor laws require an employer to provide an employee required to perform work for more than five (5) hours during a shift with, a thirty (30) minute uninterrupted meal break prior to the end of the employee’s fifth (5th) hour of work and a second uninterrupted meal break when employees are required to work ten (10) hours.
Additionally, the class action lawsuit alleges that DEFENDANT unlawfully and unilaterally failed to accurately calculate wages for overtime worked by PLAINTIFF and other members of the CALIFORNIA CLASS in order to avoid paying these employees the correct overtime compensation. As a result, PLAINTIFF and the other members of the CALIFORNIA CLASS forfeited wages due them for working overtime without compensation at the correct overtime rates.
