Senate Confirms Trump-Aligned Emil Bove to Third Circuit After Whistleblower Battle

📝Summary:

The U.S. Senate narrowly confirmed Emil Bove—a former Trump personal lawyer and senior Justice Department official—to a lifetime appointment on the U.S. Court of Appeals for the Third Circuit, responsible for Delaware, New Jersey, and Pennsylvania. The vote was 50–49, with two GOP senators—Susan Collins and Lisa Murkowski—joining Democrats against the nomination.

Bove’s nomination faced heavy criticism. Over 900 former DOJ attorneys and 76 former judges warned the Senate Judiciary Committee that his actions represented a dangerous politicization of the department. Their concerns involved his role in dismissing a corruption case against NYC Mayor Eric Adams and his role in the January 6 investigations. DOJ attorneys could defy court orders during immigration enforcement; another alleged he misled the committee over handling of the Adams case, supported by audio recordings; and others raised concerns over his treatment of career prosecutors. Bove denied all allegations, stating his critics were motivated by politics.

During the Senate Judiciary hearing, Democrats staged a walkout after GOP proceeded with his nomination despite calls for delay and whistleblower testimony. Chairman Chuck Grassley defended the process, dismissing criticisms as partisan rhetoric. Bove, seen by Republicans as a qualified conservative jurist, emphasized his legal policy credentials—including prior work as a terrorism prosecutor and major DOJ figure.

In his Senate questionnaire, Bove declined to denounce the January 6 insurrection, citing ongoing litigation, and refused to rule out a third Trump term, raising alarms among Democrats over his political sympathies and judicial temperament.

With Bove’s confirmation, Republicans now hold a conservative majority on the Third Circuit—continuing Trump’s strategic reshaping of the federal judiciary in his second presidential term. Other judicial and DOJ nominees are reportedly pending Senate votes in the coming months.
